1. About These Terms
These Terms & Conditions apply to services provided by A.J Gatt & K.A Gatt, trading as Wiggle & Giggle Dance, referred to in these terms as “Wiggle & Giggle,” “we,” “us” or “our.”
They apply to:
dance, movement and social sessions
trial sessions
session passes and packages
workshops and special events
community participation activities
booked support services
NDIS-funded and self-funded services
bookings made through our website, forms or other booking systems
purchase of any merchandise.
Some services may also have additional conditions in a booking form, event listing, consent form, service agreement or support plan.
Where an individual service agreement applies, it must be read together with these Terms & Conditions.
By making a booking, purchasing a pass, completing a form, entering a service agreement or attending a Wiggle & Giggle activity, you agree to these Terms & Conditions.
2. Our Approach
Wiggle & Giggle provides inclusive, flexible and welcoming opportunities for people of all ages and abilities.
Participants may move, communicate, take breaks and join activities in ways that work for them.
There is no pressure to:
complete every activity
copy movements exactly
remain in one place
participate continuously
communicate in a particular way.
Participants may use the Cozy Corner or take a break whenever needed.
Everyone attending must treat participants, families, carers, workers, volunteers and venue staff with dignity and respect.
3. Bookings and Registration
Bookings are subject to availability and participant limits.
We may require registration, consent, emergency contact, support or service agreement forms to be completed before attendance.
The person completing the booking must provide information that is accurate and current.
A booking is confirmed only when accepted by Wiggle & Giggle.
Walk-in attendance may be accepted where space and staffing allow, but availability cannot be guaranteed.
We may decline or postpone a booking where:
the activity is full
required forms or information have not been provided
payment has not been arranged
required support has not been booked
we cannot safely provide the requested service
attendance would create a serious safety risk that cannot reasonably be managed.
Where possible, we will discuss alternative options or reasonable adjustments.
4. Trial Sessions
Trial sessions are subject to availability.
Unless otherwise state
only one free trial is available to each new participant
required forms must be completed
a parent, carer or support worker must remain where required
a trial does not guarantee an ongoing place.
We may change or withdraw a trial offer before the booking is confirmed.
5. Parent, Carer and Support Worker Responsibilities
Unless separately booked support has been confirmed in writing, the participant’s own parent, carer or support worker must remain onsite and retain responsibility for the participant.
The attending parent, carer or support worker must:
remain available and attentive
provide any personal care, toileting, behavioural, communication, mobility or medication support required
supervise the participant outside the main activity space
assist with safe participation where needed
follow reasonable safety directions
tell us about changes in the participant’s needs
ensure the participant arrives and leaves at the agreed time.
A participant must not be left in our care unless a separate support service has been booked and confirmed.
6. Separately Booked Support
Separately booked support may include:
individual support
small-group support
support during a session
community participation support
transport where specifically agreed.
Support must be booked and confirmed before it begins.
The presence of a Wiggle & Giggle worker, assistant or volunteer does not mean individual support has been booked.
Separately booked support may be subject to:
a service agreement
an agreed support ratio
worker availability
risk and support information
minimum booking periods
separate support charges
cancellation conditions
transport arrangements.
7. Participant Information
Participants, parents and authorised representatives must provide information reasonably necessary for safe service delivery.
This may include information about:
health and medical conditions
allergies
medication
communication preferences
sensory needs
mobility and accessibility
personal care
behaviours that may create a safety risk
emotional regulation
emergency responses
relevant support plans.
Wiggle & Giggle must be told when this information changes.
Providing disability, health or support information does not automatically prevent participation. We use this information to understand needs and consider appropriate adjustments.
8. Participation and Choice
Participation is voluntary.
Participants may:
observe before joining
participate in some activities but not others
take breaks
use sensory or communication supports
request reasonable adjustments
choose not to be touched
stop an activity at any time.
Participants will not be forced, shamed or punished for choosing not to participate.
9. Safe and Respectful Conduct
We understand that communication, distress and emotional regulation may look different for each person.
A participant will not be excluded simply because they:
make noise
move differently
communicate without speech
need a break
become overwhelmed
participate differently from others.
We may intervene where conduct creates an immediate or serious risk of harm.
We may:
pause an activity
provide additional space
reduce demands
move equipment
ask a parent, carer or support worker to assist
support the participant to move to another area
end participation for that day
contact emergency services where necessary.
Violence, abuse, bullying, harassment, discrimination, exploitation, deliberate property damage and threatening conduct are not accepted.
10. Health and Illness
Please do not attend where the participant or accompanying person:
has vomiting or diarrhoea, or has experienced either within the previous 48 hours
has a contagious illness
has been advised to isolate or avoid group settings
is too unwell to participate safely
has been directed by a health professional or public health authority not to attend.
Where symptoms develop during an activity, we may ask the person to leave or arrange collection.
We take reasonable infection prevention steps but cannot guarantee that any shared venue will be completely free from viruses, bacteria, allergens or other health risks.
11. Allergies, Food and Medication
Relevant allergies and emergency responses must be disclosed before attendance.
Food may be present during some sessions, events and community activities.
We may take reasonable precautions after being told about an allergy, but we cannot guarantee that a shared venue, product or community location will be completely free from allergens or cross-contamination.
Participants must bring prescribed emergency medication where required.
Wiggle & Giggle workers will not administer medication or provide personal care unless this has been specifically agreed, documented and allocated to a trained and authorised worker.
Otherwise, medication and personal care remain the responsibility of the participant’s parent, carer or support worker.
12. Emergencies and Incidents
In an emergency, we may take reasonable action to protect the participant and others.
This may include:
providing first aid within our training
contacting emergency contacts
calling emergency services
following evacuation procedures
sharing relevant information with emergency responders
moving people away from a hazard.
Ambulance, medical and emergency service costs remain the responsibility of the participant or their representative unless the law requires otherwise.
Relevant incidents may be recorded, reviewed and reported where required.
13. Arrival and Collection
Participants should arrive and leave at the times stated in their booking.
Unless separately arranged, supervision is only provided during the booked service time.
Parents, carers and support workers remain responsible before and after the booked activity.
Participants must be collected promptly.
Repeated or significant late collection may lead to:
an additional charge where agreed
a review of support arrangements
a requirement to book separate support
suspension of future attendance until suitable arrangements are agreed.
14. Fees and Payments
Current prices are shown on our website, booking forms, invoices, event listings or service agreements.
Fees may vary depending on:
the activity
duration
support ratio
staffing requirements
event or venue costs
transport
NDIS funding arrangements
additional services selected.
Payment must be made by the due date and through the method stated in the booking information or invoice.
A booking may be cancelled or future bookings paused if payment remains overdue.
Wiggle & Giggle is not currently registered for GST and does not add GST while this remains the case.
Prices may change with reasonable notice. A price change will not usually affect a service that has already been paid for and confirmed.
15. Merchandise and Product Purchases
Wiggle & Giggle may sell merchandise and other products at our venue, sessions, events or activities. This may include socks, clothing, accessories, sensory items, dance-related products and promotional items.
Prices and Payment
Current prices will be displayed at the point of sale.
Payment is required at the time of purchase unless another arrangement has been agreed.
Wiggle & Giggle is not currently registered for GST and does not add GST while this remains the case.
All merchandise is subject to availability.
Product Information
We take reasonable care to ensure product descriptions, sizes and prices are accurate.
Customers are responsible for checking available product information, including sizing, care instructions, age recommendations and intended use, before purchasing.
Change-of-Mind Returns
Wiggle & Giggle is not required to provide a refund or exchange where a customer changes their mind, chooses the wrong product or selects the wrong size.
However, we may choose to offer an exchange or store credit where:
the customer contacts us within 14 days of purchase
proof of purchase is provided
the item is unused, unworn and unwashed
the item remains in its original condition
tags and packaging remain attached where applicable
a suitable replacement is available.
Any change-of-mind exchange or store credit is offered at Wiggle & Giggle’s discretion and does not affect rights under Australian Consumer Law.
Socks and Hygiene-Sensitive Products
For hygiene reasons, socks and other hygiene-sensitive products cannot usually be returned or exchanged for a change of mind once they have been worn, tried on or removed from sealed packaging.
This does not apply where the product is faulty, unsafe, incorrectly described or otherwise fails to meet a consumer guarantee under Australian Consumer Law.
Faulty or Incorrect Products
Products sold by Wiggle & Giggle come with consumer guarantees that cannot be excluded under Australian Consumer Law.
A customer may be entitled to a repair, replacement or refund where a product:
is faulty or unsafe
is not of acceptable quality
is significantly different from its description
is not fit for an agreed purpose
is different from the product purchased.
The available remedy will depend on the nature of the problem and Australian Consumer Law.
We may request reasonable proof of purchase, such as a receipt, invoice, order record or bank statement.
Product Care and Safety
Customers must follow any care instructions, warnings and age recommendations provided with the product.
Wiggle & Giggle is not responsible for ordinary wear and tear, misuse, accidental damage or failure to follow care instructions, except where responsibility cannot legally be excluded.
Customers should stop using any product that appears damaged or unsafe and contact us promptly.
16. Session Credits and Packages
Where a session credit or package is purchased:
it may only be used for eligible services
each attendance uses one visit or the equivalent credits
a pass does not guarantee a place in a particular session
bookings remain subject to availability
passes cannot be redeemed for cash
resale is not permitted
transfers require approval from Wiggle & Giggle.
Nothing in this section limits rights under Australian Consumer Law.
17. General Session Cancellations
We ask for at least 12 hours’ notice when a participant cannot attend a general session.
Where at least 12 hours’ notice is provided, we may:
move the booking to another available session
restore a pass visit
provide a credit
make another reasonable arrangement.
Where less than 12 hours’ notice is provided, or the participant does not attend, the fee or pass visit may be forfeited.
We understand that emergencies, illness and unexpected disability-related circumstances may occur and may waive or adjust the cancellation condition where reasonable.
Different conditions may apply to events, special programs, community activities or separately booked support.
18. NDIS Cancellation Charges
NDIS cancellation charges will only be applied where:
the cancellation arrangement has been agreed with the participant or their authorised representative
the charge is permitted under the current NDIS Pricing Arrangements and Price Limits
the requirements for claiming the cancellation have been met
appropriate records are maintained.
The participant’s service agreement will explain the cancellation arrangements that apply to their support.
A cancellation will not be charged to an NDIS plan only because it is mentioned in these website terms.
19. Cancellations by Wiggle & Giggle
We may cancel, relocate, postpone or change a service because of:
worker illness
insufficient bookings
venue closure
unsafe weather
emergencies
public health requirements
facility or equipment failure
circumstances outside our reasonable control.
Where we cancel a paid service and cannot provide a reasonable alternative, we will generally offer a transfer, replacement session, credit or refund for the service not provided.
We are not responsible for indirect costs such as private travel, accommodation or lost wages unless required by law.
20. Refunds and Consumer Rights
A change of mind does not automatically create a right to a refund.
Refund requests will be considered based on:
the booking conditions
the reason for the request
whether the service has already been provided
non-recoverable costs
Australian Consumer Law.
Nothing in these Terms & Conditions removes rights under Australian Consumer Law.
Where applicable, services must be:
provided with due care and skill
fit for an agreed purpose
provided within the agreed or reasonable time.
Where a service does not meet a consumer guarantee, a person may be entitled to a repair of the service, replacement service, credit, refund, cancellation or compensation depending on the circumstances.
21. Events, Workshops and Special Programs
Events and special programs may have additional conditions, including:
different prices
ticket limits
age requirements
payment deadlines
different cancellation periods
material or venue costs
specific arrival and collection arrangements
food, costume or equipment requirements.
Additional conditions will be provided before booking.
External venues, suppliers or vendors may also have their own terms.
22. Community Activities and Outings
Community activities may require:
a separate booking or service agreement
emergency and support information
transport consent
spending money arrangements
an agreed support ratio
activity permission
a risk assessment or planning discussion.
Unless otherwise stated, participants are responsible for their own:
food and drinks
purchases
entry fees
activity costs
personal equipment.
23. Transport
Transport is only provided where it has been specifically booked and confirmed.
Transport arrangements may include:
pickup and drop-off locations
agreed times
vehicle capacity
Seatbelts or safety equipment
supervision arrangements
transport charges or kilometre costs.
Seatbelts and legally required restraints must be used.
We may decline or stop transport where continuing would be unsafe or unlawful.
24. NDIS-Funded Services
Wiggle & Giggle may provide services to self-managed and plan-managed NDIS participants where we are lawfully able to provide the selected support.
As an unregistered provider, we generally cannot provide supports that require registration or claim directly from NDIA-managed funding unless permitted.
The participant or their representative is responsible for confirming:
that the service can be purchased using their funding
that sufficient funds are available
whether their plan manager requires further information
that the service is appropriate for their plan.
We cannot guarantee that the NDIA or a plan manager will approve or pay an invoice.
Where an invoice is rejected because of insufficient funding or an incorrect funding arrangement, the person responsible for payment may need to pay privately where this has been agreed.
We will not knowingly charge a participant more solely because they use NDIS funding.
25. Service Agreements
A service agreement may be required for ongoing or separately arranged NDIS supports.
A service agreement may include:
the supports being provided
prices and payment
participant goals
support ratios
responsibilities
times and locations
cancellations
travel and transport
reviews
how the agreement may be ended.
Participants may ask questions and seek help from a nominee, advocate, interpreter or trusted person before signing.
26. Photography, Video and Audio
Photography and recording consent is optional and separate from attendance.
We will seek consent before using identifiable images or recordings for advertising, social media or public promotion.
Declining media consent will not prevent participation.
Consent may be withdrawn for future use by contacting us.
Withdrawal may not allow us to retrieve material already lawfully printed, distributed or shared by others, but we will take reasonable steps to remove it from platforms we control where practicable.
People attending must not photograph, film or record another participant without permission.
27. Privacy and Confidentiality
Personal and sensitive information will be handled according to our Privacy Policy and applicable law.
Participants and accompanying people must respect the privacy of others.
Information heard or observed about another participant must not be shared without permission, except where disclosure is required for safety or by law.
Our Privacy Policy is available on our website.
28. Personal Belongings and Property
Participants are responsible for their own belongings.
Items should be clearly labelled where possible.
Wiggle & Giggle will take reasonable care but is not responsible for ordinary loss, theft or damage unless caused by our failure to exercise reasonable care or where responsibility cannot lawfully be excluded.
A person may be asked to pay reasonable repair or replacement costs where they deliberately or recklessly damage property.
Normal wear, accidental damage and disability-related incidents will be considered fairly and respectfully.
29. Accessibility and Reasonable Adjustments
Participants may request reasonable adjustments.
We will consider:
the participant’s needs and preferences
safety
the nature of the service
available workers and resources
venue limitations
the effect on others
whether the adjustment would cause unjustifiable hardship.
We cannot guarantee that every requested adjustment will be possible, but we will discuss suitable alternatives where practicable.
30. Suspension or Ending Services
We may suspend or end a service where:
required payments remain overdue
essential information has not been provided
the agreed support arrangement is no longer adequate
there is a serious safety risk
there has been violence, abuse, harassment, fraud or serious misconduct
the service is outside our role, ability or insurance coverage
continuing would be unlawful.
This decision will not be based merely on a person’s disability, communication style, support needs or need for reasonable adjustment.
Where practicable, we will explain the concern, involve the participant and their representative, consider adjustments and provide reasonable notice.
Immediate action may be taken where necessary to prevent harm.
31. Complaints and Feedback
Participants, families, carers and advocates may provide feedback or make a complaint verbally or in writing.
A person will not be treated unfairly because they make a complaint.
We will:
listen respectfully
acknowledge the complaint
protect privacy
consider the matter fairly
keep the person informed where appropriate
provide a response within a reasonable period
take corrective action where required.

NDIS participants may also contact the NDIS Quality and Safeguards Commission about the quality or safety of NDIS supports.
Privacy complaints may also be made to the Office of the Australian Information Commissioner where applicable.
32. Liability
Dance, movement, games, crafts and community activities involve ordinary risks such as slips, trips, falls, accidental contact, muscle soreness and sensory overwhelm.
Wiggle & Giggle will take reasonable steps to provide services safely and with appropriate care and skill.
Participants and their representatives must:
provide relevant information
follow reasonable safety directions
use equipment appropriately
report hazards or injuries
provide required personal support unless separately booked.
Nothing in these terms excludes liability or legal rights that cannot lawfully be excluded.
33. Website and Intellectual Property
We take reasonable care to keep our website accurate, but session times, venues, prices, availability and services may change.
A booking confirmation, invoice or service agreement may contain more current information than a general website page.
Unless otherwise stated, Wiggle & Giggle owns or is authorised to use its branding, written materials, forms, graphics, photographs, videos, session plans and promotional content.
This material must not be copied, sold, altered, published or used commercially without permission.
34. Changes to Services and These Terms
We may make reasonable changes to:
activities
session structures
times
venues
workers
prices
participant limits
booking processes
available services.
Reasonable notice will be provided where a change significantly affects an existing booking or ongoing arrangement.
These Terms & Conditions may also be updated when our services, legal obligations or business practices change.
The current version will be published on our website.
35. Changes and Communication
Wiggle & Giggle may contact participants, parents, carers or authorised representatives about:
bookings and confirmations
session reminders
cancellations or venue changes
payment and invoice matters
health and safety information
service updates
changes to programs, prices or policies
information required to provide support safely.
Communication may be sent by email, text message, telephone, booking system, website notice or another agreed method.
Participants and their representatives are responsible for keeping their contact details current and checking messages relating to their bookings and services.
We will provide reasonable notice of significant changes where practicable. Urgent changes may be communicated with less notice where caused by illness, emergencies, venue issues, weather, safety concerns or circumstances outside our reasonable control.
Promotional messages will only be sent where appropriate, and recipients may unsubscribe from promotional communications. Essential service, safety, booking and payment communications may still be sent where necessary.
36. Agreement
By making a booking, purchasing a pass, completing a registration form, signing a service agreement or attending a Wiggle & Giggle session, event or activity, the participant or person responsible for the booking confirms that they:
have read and agree to these Terms & Conditions
have provided accurate and relevant participant information
understand the parent, carer and support worker responsibilities that apply
understand the payment, cancellation, refund and merchandise conditions
understand the photography, video and audio consent arrangements
acknowledge the ordinary risks associated with dance, movement, games, crafts, events and community activities
agree to follow reasonable safety directions
understand that separately booked support must be confirmed before a participant is left in Wiggle & Giggle’s care.
Nothing in this agreement removes or limits any rights that cannot legally be excluded under Australian Consumer Law or other applicable laws.
37. Governing Law
These Terms & Conditions are governed by the laws of Queensland, Australia.
